Yeah, it is almost certainly the same setting, just from a different angle, or maybe a slight home renovation.

I swear the scarecrow was the observer in this episode. Peter even made a comment to that effect.

I noticed this but wrote it off as one of the local police. There were tonz of them that were bald. We need more proof than this fuzzy photo.
Interesting idea about the scarecrow... not quite sure how that makes any sense though... isn't sentient intelligence implied in the act of observing? inanimate unintelligible objects can or can't observe? Its unusual for us to attribute any verb to them isn't it? So then what sentient intelligence was in or on the scarecrow? Webcam?
My guess is that the observer wasn't in this episode. He only seems to be around when the case is about the pattern not when there is a case. IMO some of the cases have nothing to do with the overall story other than being an unordinary event.

imho its obviously the observer he has the classic appearance black suit with briefcase merely observing. if it was a cop he wouldnt be standing(still i might add) in the fashion he is carrying that briefcase, he would be moving around and conducting an investigation.
This Scene is 24mins 39 secs into the episode Aprox. since nobody else was helpful enough to let us know.
It's a good chance that this is the same house as from the X-Files because the filming of Fringe has moved to Vancouver, where the X-Files was filmed for the first 5 seasons
It is definitely the observer. Also to the person who said that this is not the pattern, all cases relate to the pattern. Just like all of the subjects during the intro, this would fall under the "mutation" category listed.
