The Observer can clearly be spotted in the Fringe episode Snakehead, in Boston's Chinatown right after Ming Che makes a phone call after learning about Walter's 4 foot worm.

He's very clearly in the scene after Walter mentions the 4 foot worm and the older Chinese man makes a phone call--right after that.

The sighting at the begining of the episode may have just been a bald man walking down the same street as the victim or another observer
I believe there might be some significance to the rocket graffiti drawn on the pay phone, too
